The New Jersey Consumer Fraud Act offers individuals in New Jersey a wide variety of protections against illegal practices and abuses by merchants, home repair contractors and new and used automobile dealers.
Consumer fraud is an increasingly common occurrence, usually resulting in serious financial losses and even bankruptcy for victims. The New Jersey Consumer Fraud Act permits the recovery of treble damages and attorney's fees under certain circumstances.
Consumer Fraud may include some or all of the following activities:
Home Contractors: Unfinished contracts, misleading estimates, stolen deposits, failure to build to code, unreasonable delays in completion, unauthorized changes to specifications, demanding full payment before the work is completed or a final inspection is made, dangerous electrical and plumbing work by unlicensed workers, and many other illegal and deceptive practices;
Auto Sales/Leases: Deceptive advertising, misrepresentations concerning financing arrangements, damaged vehicles sold without the damage being disclosed, odometer fraud, unfair leases, use of inferior/used parts in repairs, misleading warranties, undisclosed fees, and countless other fraudulent misrepresentations made to convince consumers to buy or lease automobiles;
Automotive Repairs: Failure to provide a written estimate before work begins, unnecessary repairs, failure to provide regulatory protections in contracts;
Banking & Credit Cards: Undisclosed fees and interest on loans and credit, unreasonable collection practices for delinquent accounts, outrageous late fees and interest, inaccurate credit reporting, and a myriad of other unfair advertising and promotional practices.
Fortunately, New Jersey is one of the few states that encourages taking aggressive action against less than honest merchants. However, the consumer may not be able to fully benefit from these laws unless he is properly represented by attorneys fully familiar with the broad remedies which are available.
